Daredevil.gg – Testnet Terms of Service (TOS)
1. Acceptance of Terms and Identification of Entity
By accessing or using the decentralized prediction market platform available at daredevil.gg (the “Platform”), you are entering into an agreement with New Prontera Corp., a Web3/AI venture association (the “Entity”). You agree to be bound by these Terms of Service (“TOS”). If you do not agree to all the terms and conditions of this agreement, you must not access or use the Platform.
2. Platform Status: Testnet, Open-Source, and Decentralized
2.1 Testnet and “As-Is” Status
THE PLATFORM IS CURRENTLY OPERATING ON A TEST NETWORK (TESTNET). IT IS INTENDED FOR EDUCATIONAL, EXPERIMENTAL, AND INFORMATIONAL PURPOSES ONLY.
The Platform is provided “AS IS,” “WITH ALL FAULTS,” and “AS AVAILABLE.” Use of the Platform is at your sole risk. There is no guarantee of platform availability, data persistence, or functionality. All data, testnet tokens, and activity are subject to unannounced change, failure, or complete loss.
2.2 Decentralized and Open-Source Nature
The Platform is built on decentralized, open-source smart contracts. You acknowledge that:
The Entity, its founders, core developers, or any individuals associated with the Platform (collectively, the “Associated Parties”) do not control the underlying blockchain or smart contract code once deployed.
Your interaction is primarily with the smart contracts, and the Associated Parties have no custodial or centralized control over your funds or activities.
3. Mission Disclaimer (AI and Prediction Assistance)
The Platform’s stated mission is to help users make better predictions, including potentially aiding individuals struggling with high-risk betting habits, through AI-powered analysis.

4. Exclusion of All Liability

To the maximum extent permitted by applicable law, the Entity and its Associated Parties (collectively, the “Indemnified Parties”) shall NOT be liable for any damages, losses, liabilities, costs, or expenses (including, without limitation, direct, indirect, incidental, consequential, special, punitive, or exemplary damages) arising out of or in connection with your use of the Platform, regardless of the cause.
This exclusion of liability includes, but is not limited to, damages arising from:
Fortuitous Incidents: Platform downtime, network failures, loss of data, errors, or temporary service interruptions.
Malicious Incidents (Hacks): Theft of funds, unauthorized access to the Platform, phishing attacks, or any malicious third-party activities.
Software Faults: Bugs, vulnerabilities, or exploits within the underlying smart contract code, the open-source front-end code, or any associated APIs.
User Errors: Loss of private keys, incorrect transactions, or misuse of the Platform.
Reliance on AI: Any financial loss resulting from relying on the AI-powered prediction tools.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK, AND YOU ARE SOLELY RESPONSIBLE FOR ANY LOSSES INCURRED.
5. Risk Assumption
By using the Platform, you acknowledge, understand, and assume all risks inherent in using decentralized, smart-contract-based applications, including:
The risk of smart contract failure or exploit.
The risk of regulatory uncertainty and legal changes impacting decentralized technologies.
The risk of financial loss due to market volatility or incorrect predictions.
6. Indemnification
You agree to indemnify, defend, and hold harmless the Indemnified Parties from and against any and all claims, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these TOS, your misuse of the Platform, or your violation of any law or the rights of any third party.
7. Governing Law
These TOS shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.
